DataPockets is operated by OnHand LLC, a Kansas limited liability company ("we," "us," or "our"). By accessing or using our website at datapockets.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

Section 2What DataPockets Is Right Now

DataPockets is currently in pre-launch. The Site exists solely to share information about our upcoming product and to collect email addresses from people interested in early access. Joining the waitlist does not create an account, does not constitute a purchase, and does not guarantee access to any product or pricing. We are simply keeping you in the loop.

Section 3Use of the Site

By using this Site, you agree to use it only for lawful purposes and in a way that does not infringe the rights of others. You agree not to:

• Use the Site for any unlawful or fraudulent purpose
• Attempt to gain unauthorized access to any part of the Site or its infrastructure
• Transmit any harmful, offensive, or disruptive content
• Use automated tools to scrape or harvest data from the Site
• Impersonate DataPockets, OnHand LLC, or any other person or entity

Section 4Waitlist & Email Communications

When you submit your email address to join our waitlist, you are giving us permission to contact you with updates about DataPockets, including launch announcements and early-access opportunities. We will not spam you. You can unsubscribe at any time by clicking the unsubscribe link in any email we send, or by contacting us directly at will@datapockets.com.

Section 5Intellectual Property

All content on this Site — including the DataPockets name, logo, tagline, copy, images, and design — is the property of OnHand LLC and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works from any content on this Site without our express written permission.

Section 6Disclaimer of Warranties

This Site is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Any descriptions of the DataPockets product, pricing, or features on this Site are for informational purposes only and are subject to change before launch. Nothing on this Site constitutes a binding offer or commitment.

Section 7Limitation of Liability

To the fullest extent permitted by law, OnHand LLC and its members, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of — or inability to use — this Site or its content. Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed one dollar ($1.00). This limitation reflects the fact that no financial transactions occur on this Site at this time.

These Terms are governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Kansas. By using this Site, you consent to the personal jurisdiction of those courts.

Section 11Changes to These Terms

We may update these Terms as DataPockets evolves — particularly before we launch and begin accepting payments or storing user data. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify waitlist members by email. Continued use of the Site after any changes take effect constitutes your acceptance of the updated Terms.
